".SHANGBIAO" Domain Registry Invited to Attend ADNDRC Conference

On June 5, 2015, a conference titled "Online Dispute Resolution in the Internet Plus Era" (the "ADNDRC 2015 Conference") cosponsored by the Online Dispute Resolution Centre of the China International Economic and Trade Arbitration Commission (CIETAC ODRC) and the Asian Domain Name Dispute Resolution Centre (ADNDRC) was held in Beijing.

 

Founded in 2002, ADNDRC is a domain name dispute resolution institution designated by ICANN as well as by ".SHANGBIAO" (dot trademark in Chinese) Domain Registry. ADNDRC Conference is normally held once a year in a major Asian city, and serves as an important platform on which to discuss issues about the Internet and dispute resolution and put forth innovation suggestions.

 

 

 

Around 200 people from China, South Korea, Malaysia, Spain and Hong Kong attended the ADNDRC 2015 Conference, including judges, scholars, lawyers, trademark agents, domain registries and enterprise representatives. Yu Jianlong, Deputy Director and Secretary General of CIETAC attended the conference and made a welcome address on behalf of the sponsors. Qi Lin, Deputy Director of China Internet Network Information Center (CNNIC), and Song Jing, Director of the Beijing Cooperation Center of the Internet Corporation for Assigned Names and Numbers (ICANN) also attended the event and delivered speeches.

 

As a globally generic top level domain authorized by ICANN to use Chinese "trademark" as suffix, ".SHANGBIAO" Domain Registry attended the event at the invitation of the organizing committee. Mr. Wu Yangyi, Operating President of China Region of “.SHANGBIAO” Domain Registry, as a special guest, made a keynote speech titled "Exclusive Network Address Resources for Trademark Right holders in the Internet Plus Era", during the first session of the conference – "The Rights Protection Mechanism in the new generic top level domains".

 

 

 

During his speech, Mr. Wu stressed that in the "Internet Plus" era, trademark/brand right holders are confronted with the double subject of brand building and intellectual property protection on the Internet. Meanwhile, the vast netizens require a trademark identification on the Internet consistent with the conventional trademarks and easy to use online to facilitate online search, identification and distinguishing of various sources of commodities and services by netizens and consumers, reduce confusion and annoyance in the recognition and use of trademarks due to inconsistent online and offline trademark names, thus decreasing the loss resulting from purchasing the counterfeit commodities and service or wrongly entering the phishing websites. In the meantime, the trademark right holders also hope that their trademark rights can be extended, expanded and protected on the Internet, and their trademarks can be represented, managed, used and promoted online and offline consistently so as to prevent their trademarks from being counterfeited, fraudulently copied or infringed on the Internet and safeguard their Internet business interests.

 

To maintain the interests of consumers, netizens, businessmen and enterprises, foster a healthy Internet eco-environment with sustainable development, the innovative intellectual property logo ".SHANGBIAO" with both trademark rights and domain name rights will enable trademarks to have more remarkable performance on the Internet in the Internet Plus era, allow netizens and consumers to search, identify and distinguish commodities and services or real, authentic and obvious network logos of information sources of relevant individuals, enterprises or organizations, enable trademark right holders to use, express, popularize, make public their rights and protect their rights on the world Internet, and allow trademark rights to extend and expand online.

 

 

 

Next, on issues concerning disputes that may arise from the operation of the ".SHANGBIAO" domain name, Mr. Wu expressed that ".SHANGBIAO" Domain Registry has stipulated rigorous registration and usage rules to ensure each ".SHANGBIAO" domain name corresponds to its trademark right holder, so as to prevent the abuse of domain names and malicious cybersquatting, resolve disputes arising from registration qualifications of domain name registrants, and fully protect the legal rights and interests of trademark right holders. In addition, ".SHANGBIAO" Domain Registry has also introduced a sound domain name dispute resolution mechanism by which to submit disputes arising from ".SHANGBIAO" registration to the ADNDRC for settlement in accordance with relevant dispute resolution policies.

 

Mr. Wu added that, since the official rollout of ".SHANGBIAO" on January 8, 2015, a number of well-known domestic and international brands had scrambled for registering their ".SHANGBIAO" domain names. Domain names of famous brands such as Baidu, Gome, Vipshop, S.F. Express, Starbucks have been successively put to use and resolved to their official websites. It is because of such rigorous registration rules that the ADNDRC has not received any dispute arbitration case about ".SHANGBIAO" domain names.
